These Terms & Conditions ("Terms") govern your access to and use of All420USA.com (the "Site") and any purchase you make from All420USA ("we," "us," or "our"). By accessing the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Shipping Policy, and Return Policy, each incorporated here by reference. If you do not agree, do not use the Site or place an order.

1. Age Requirement & Eligibility

All products sold on this Site are intended strictly for adults of legal age. You must be at least 21 years of age (or the minimum legal age in your jurisdiction, whichever is higher) to view the Site, create an account, or place an order. By placing an order, you represent and warrant, under penalty of law, that:

  • You are at least 21 years old;
  • The billing and shipping information you provide is accurate and belongs to you or to a person of legal age who has authorized the purchase;
  • You are purchasing for personal, lawful use and not for resale to minors;
  • The products you order are legal to purchase, possess, and use in your jurisdiction.

We use third-party age-verification tools and reserve the right to request government-issued identification prior to shipment. We may cancel, refuse, or delay any order that fails age verification, with no obligation beyond refunding the purchase price.

2. Product Use, Intended Purpose & No Medical Claims

Products offered on this Site — including batteries, vaporizer devices and kits, grinders, rolling trays, scales, torches and butane, glassware, storage containers, and related accessories — are sold as general consumer goods for use with legal materials only. We make no representation that any product is intended for use with any specific substance. Nothing on this Site is intended to diagnose, treat, cure, or prevent any disease or medical condition, and no statement on the Site has been evaluated by the U.S. Food and Drug Administration. You are solely responsible for using every product lawfully, safely, and in accordance with the manufacturer's instructions.

3. Assumption of Risk & Safety

Certain products — including lithium-ion batteries, vaporizers, torches, and butane — can be hazardous if misused. You acknowledge and voluntarily assume all risks associated with the purchase, handling, charging, storage, and use of these products. You agree to follow all manufacturer safety instructions, use only compatible chargers and components, and keep all products away from minors, heat, and moisture. We are not responsible for any injury, property damage, fire, or loss resulting from misuse, improper charging, modification, or negligent handling of any product.

4. Pricing, Product Information & Availability

We strive for accuracy, but the Site may contain typographical errors, inaccuracies, or omissions relating to price, description, availability, or images. We reserve the right to correct any error and to change or update information at any time without prior notice, including after an order has been submitted. If a product's correct price is higher than the price shown at checkout, we will either contact you for approval before shipping or cancel the order and issue a refund. Colors and appearance may vary; many items ship in "random" or "assorted" colors as noted on the product page, and color selection cannot be guaranteed.

5. Orders, Acceptance & Cancellation

Your submission of an order is an offer to purchase. All orders are subject to acceptance by us, and no contract is formed until we accept and ship the order. We reserve the right, in our sole discretion, to limit quantities, refuse, or cancel any order for any reason, including suspected fraud, reseller activity, pricing errors, or failed verification. If we cancel an order after payment, your sole remedy is a refund of the amount paid.

6. Payment & Authorization

By submitting payment information, you represent that you are authorized to use the payment method and you authorize us to charge the full order amount, including taxes and shipping. You agree to reimburse us for any amounts we are unable to collect. We reserve the right to use third-party fraud-screening services and to decline transactions that fail our risk checks.

7. Chargebacks & Payment Disputes

We take payment fraud and improper disputes seriously. By placing an order, you agree to contact us first to resolve any issue before initiating a chargeback or payment dispute with your bank or card issuer. Filing a chargeback for a valid, delivered order — or for a claim covered by these Terms (for example, a claim of "item not received" for a package our carrier confirms as delivered, or buyer's remorse on a non-returnable item) — constitutes a breach of these Terms.

You agree that the following are valid evidence sufficient to rebut a dispute: carrier tracking showing delivery, age- and identity-verification records, IP and device logs, order confirmations, and communications with you. In the event of a chargeback that we successfully rebut, or a chargeback filed in bad faith, you agree to be responsible for the original order amount, any chargeback and administrative fees we incur, and reasonable costs of collection, including attorneys' fees where permitted by law. We further reserve the right to refuse future service, block the associated account and payment method, and report fraudulent disputes to the card networks and relevant authorities.

8. Limited Warranty

We provide a limited warranty only on batteries and vaporizer kits, and only for a period of thirty (30) days from the date of delivery. This limited warranty covers manufacturer defects only — that is, a unit that arrives dead-on-arrival or that fails during normal, proper use due to a defect in materials or workmanship.

This limited warranty expressly does NOT cover:

  • Accidental damage of any kind;
  • Physical breakage, cracks, drops, or impact damage;
  • Water, liquid, or moisture damage;
  • Damage from misuse, abuse, neglect, improper charging, incompatible chargers or components, or modification;
  • Normal wear and tear, or depletion of battery capacity over time;
  • Coils, atomizers, pods, glass, wicks, and other consumable or wear parts;
  • All other product categories, including but not limited to grinders, scales, rolling trays, torches, butane, glassware, storage containers, novelty items, and all accessories, which are sold AS-IS with no warranty of any kind.

To make a valid warranty claim, you must contact us within the 30-day window with your order number, a description of the defect, and photo or video evidence. Approved claims are resolved, at our sole discretion, by replacement of the defective unit or store credit. We do not cover return shipping on warranty claims unless required by law. This limited warranty is non-transferable and applies only to the original purchaser.

9. Disclaimer of Warranties

EXCEPT FOR THE LIMITED 30-DAY WARRANTY ON BATTERIES AND VAPORIZER KITS EXPRESSLY STATED IN SECTION 8, ALL PRODUCTS AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of certain implied warranties, so portions of this section may not apply to you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALL420USA, ITS OWNERS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless All420USA and its owners, officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or connected with your use or misuse of any product, your violation of these Terms, your violation of any law, or your misrepresentation of your age or eligibility.

12. Compliance With Laws; Restricted Jurisdictions

You are solely responsible for knowing and complying with the laws of your city, county, and state regarding the purchase, possession, and use of the products you order. We do not ship to jurisdictions where a product is prohibited, and we reserve the right to cancel any order that would violate applicable law. Title and risk of loss pass to you upon our delivery of the products to the carrier.

13. Intellectual Property

All content on the Site — including text, graphics, logos, images, and product descriptions — is the property of All420USA or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use any content without our prior written permission.

14. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product shall be resolved exclusively through final and binding individual arbitration, and not in court, except that either party may bring a claim in small-claims court where eligible. You and All420USA waive any right to a jury trial and to participate in any class, collective, or representative action. Arbitration shall be administered under the rules of a recognized arbitration provider, conducted in the state in which All420USA is organized, and governed by the Federal Arbitration Act. If any portion of this section is found unenforceable, the remainder shall remain in effect.

15. Governing Law

These Terms are governed by the laws of the state in which All420USA is organized, without regard to conflict-of-laws principles. Subject to the arbitration provision above, you consent to the exclusive jurisdiction and venue of the state and federal courts located in that state.

16. Changes to These Terms

We may modify these Terms at any time by posting the revised version on the Site with an updated "Last Updated" date. Your continued use of the Site or placement of an order after changes are posted constitutes acceptance of the revised Terms.

17. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or severed, and the remaining provisions shall remain in full force. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and All420USA regarding the Site and supersede all prior agreements.
